For the seventh time, the European Court of Human Rights has indicated an interim measure requiring the Belgrade Border Police Station to refrain from the forcible removal of a Turkish national of Kurdish origin who was refused entry to Serbia yesterday at Nikola Tesla Airport. The attempt to return this person fleeing political persecution to T\u00fcrkiye, accompanied by the unlawful use of force, is a further indication of the practice of denying refugees their human rights at Belgrade airport.<\/p>\n\n\n\n
This case confirms the findings of every relevant international body: that refugees at Nikola Tesla Airport are arbitrarily detained, denied the rights of persons deprived of liberty and denied access to the territory and to the asylum procedure, and that they are forcibly put on flights without an interpreter and returned to countries where their lives are at risk and where they face torture, arbitrary detention and violations of the right to a fair trial.<\/p>\n\n\n\n
We recall that the first interim measure against the unlawful practice of the Belgrade Border Police Station was indicated in November 2013, when a torture victim, a political refugee from Iran, was almost returned to his country of origin. A similar case followed in July 2014, when a Somali journalist who had survived an assassination attempt by Al-Shabaab was about to be deported to Mogadishu. In the years that followed, the European Court prevented the forced return of refugees from Iran (2016), of a Turkish political activist (2021), of the Turkish journalist Narin \u00c7apan (2022) and of an Iranian family in which the father faced a life sentence (2022). These are only some of the cases in which legal representatives, with the assistance of the European Court of Human Rights, have managed to protect people facing forced return. Regrettably, it is estimated that every year a large number of foreign nationals in need of international protection are treated in a similar way. Among them is a woman from the Democratic Republic of the Congo who was deported in February this year, despite stating that she had been raped in her country of origin.<\/p>\n\n\n\n
The Centre for Research and Social Development IDEAS will continue to provide legal aid to refugees in the transit zone, and hopes that the recommendations of the UN Human Rights Committee, the UN Committee against Torture and the Special Rapporteur on Torture will finally be implemented, and that respect for the rights of refugees and asylum seekers at Nikola Tesla Airport will significantly improve.<\/p>\n\n\n\n
